SEPP1 Variations
Monitoring variations to development standards
A SEPP1 register records instances in which Council has determined development applications that resulted in a variation to a development standard (i.e. numerical standards specified in a State Planning Policy or a Local Environmental Plan). Monitoring of variations to development standards is important in that it enables the Department of Planning and Council to determine whether development standards are appropriate, or whether changes are required to the development standards.
SEPP 1 enables flexibility in the application of development standards, by enabling consideration of variations, in circumstances where strict compliance with those standards would, be unreasonable or unnecessary or tend to hinder the attainment of the objects specified in section 5 (a) (i) and (ii) of the Act. Environmental Planning and Assessment Act.
Council is required to keep a register of applications determined with variations in standards under SEPP 1 available on Council’s web pages.
