A business that is not operated from a permanent structure and has the ability to move between locations is identified as Mobile Business.
Examples of mobile businesses include, but are not limited to, food and drink vendors, salons, mechanics, and animal grooming.
If the business intends to set up on private land, the mobile business requires approval from the landowner to operate on their land.
If the mobile business is operating on public land, a Section 68 application for carrying out an activity on community land will be required. This does not include trading within a public road reserve.
If the mobile business involves the retail sale of food, drinks related products on land from a food truck, van, cart or similar vehicle and is able to meet the relevant development standards for Exempt Development, development consent will not be required.

- Approval to operate on a footway of a classified road will require approval from Roads and Maritime Services
- A registrable vehicle within the meaning of the Road Transport (Vehicle Registration) Regulation 2007, or cart, bicycle cart or the like must operate in accordance with the Guidelines for mobile food vending vehicles(NSW/FA/F1055/1302) and any requirements of the Food Act 2003.
