A pool or spa can be installed on land that has an existing dwelling located on it, neither can be located on a vacant allotment.
All pools and spas, even certain sized blow-up pools and DIY pools need to comply with legislation for pool safety. In most cases a pool fence or lockable lid will be required. More information about pool safety can be found on our Swimming Pool Requirements page.
There is exempt development for spas that are less than 2000L in capacity, you may review the exempt development requirements, Subdivision 30, State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 to confirm if your proposed spa does not need development approval.
Should your proposed spa not meet the exempt development criteria you will need to get development consent via either a Complying Development Certificate or a Development Application.

Development consent is required for pools that have the capacity of containing 2000L or more.
There is exempt development for portable pools less than 2000L, meaning you do not need development consent, Subdivision 30, State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.
Development consent can be obtained either by a Complying Development Certificate or a Development Application.

Should you not be able to meet the complying development requirements a Development Application will be required.
Pools over 40,000L will require a BASIX certificate
